ANJANA MISHRA ORAL ORDER 26-05-2015 Heard learned counsel for the petitioner, the learned counsel for the informant and the learned counsel for the State. The petitioner is in custody since 20.1.2015 in connection with Barauni (Refinery) P.S. Case No.407 of 2014, arising out of Complaint Case No.1332 C/14, registered for the offences under Sections 323, 341, 406, 420 and 504/34 of the Indian Penal Code.

After hearing the learned counsel for the petitioner and the learned counsel for the informant, it appears that there was some transaction of money between the petitioner and the informant, which led to the dispute and the materials, which have come on the record, only go to show that an amount of Rs.50,000/- was given to the petitioner, which, according to the petitioner, he

However, learned counsel for the informant submits that money to the tune of around Rs.3,00,000/- was taken by the petitioner from the informant for providing job in the Railways. Such facts and circumstances do not appear to be clearly established at present, however, the same can be tested further. Considering the nature of the allegations and also the fact that the petitioner has no criminal antecedents, let the above named petitioner be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai, in connection with Barauni (Refinery) P.S. Case No.407 of 2014.
