JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-01-2015 The petitioners are languishing in custody since 16-9-2014 in a case registered under sections 366(A), 120(B)/34 of the Indian Penal Code.
The accusation is of kidnappinmg of minor daughter of the informant. It has been submitted by the learned counsel that petitioner no.2 Chhotu Kumar has married the victim girl and a petition has been filed to the effect that they are living together as husband and wife and the victim girl has also filed an affidavit before the learned court below to that effect. Considering the aforesaid facts, let the above petitioner no.2 be released on provisional bail for three months on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each in connection with Imamganj P.S. Case No.
Patna High Court Cr.Misc. No.153 of 2015 (2) dt.07-01-2015 - 2 - 120/2013 to the satisfaction of learned Subdivisional Judicial Magistrate, Sherghati, Gaya, which will be confirmed by the learned court below on getting the contents of the affidavit filed by the victim girl verified after giving notice to her. Considering the fact that petitioner no.2 has been directed to be released on provisional bail, let the above petitioner no.1 be released on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount in connection with Imamganj P.S. Case No.120/2013 to the satisfaction of learned Subdivisional Judicial Magistrate, Sherghati, Gaya.
