Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Maniyari P.S. Case No. 188 of 2021 registered for the offence under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition & Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 17.09.2022 and it is alleged that there is recovery of 4993.380 liters of foreign liquor. Learned counsel for the petitioner submits that the petitioner has offered to deposit Rs. 1 Lakh in Ram Krishna

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the aforesaid facts and the period of custody, this application for regular bail is allowed. Let the petitioner, above named, be released on bail after framing of charge if the charge has not been framed yet and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise) Court No.II, Muzaffarpur/concerned Court below in connection with Maniyari P.S. Case No. 188 of 2021 subject to following conditions:- (I) One of the bailor should be blood relative of the petitioner.

(ii) The petitioner will mark his attendance at the Karja Police Station on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
