The petitioner is languishing in prison in Patna Kotwali P.S. Case No. 129 of 2014 under Sections 419, 420 and 406 of the Indian Penal Code.

The allegation against the petitioner is that in order to taking out a loan from some nationalized bank, the petitioner had placed a particular property which was not standing in his name rather it was standing in the name of his mother. Submission is that the joint family property standing in the name of the petitioner could not be said to be not the property of the petitioner and the petitioner could not be held responsible for committing offences for which he is languishing in prison.
