2. The petitioner makes a prayer for grant of regular bail in connection with Parnadabar P.S.Case No. 92 of 2025 registered for the offences punishable under Sections 30(a)of the Bihar Prohibition & Excise Act.
3. It would appear from the FIR and seizure list that total 320 liters of country made liquor was recovered from two Motorcycles, which was being driven by the petitioner and one Sunny Kumar.
4. Learned counsel for the petitioner submits that there is no recovery from physical and conscious possession of the petitioner and as a matter of fact, there is no independent witness to the seizure list. It has also been pointed out that the
Patna High Court CR. MISC. No.32382 of 2025(2) dt.19-05-2025 2/3 seizure list also bears the signature only of the Sunny Kumar and not of the petitioner. The petitioner is in custody since 21.04.2025.
5. The learned APP opposes the prayer for bail on the ground that the petitioner is in accused of one more case of the same nature, however it is submitted that the petitioner is on bail in the said case.

Considering the aforesaid facts and circumstances of the case, let the above name petitioner shall be enlarged on bail on furnishing bail bonds of Rs 10,000/- (ten thousand)with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/ successor court in Parnadabar P.S. Case No. 92 of 2025, subject to the condition that the learned court would, however, verify the criminal antecedent of the petitioner and in case it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, it is expected that the verification process would be done expeditiously without causing any delay. (Soni Shrivastava, J) N.K/- U T
