JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 13.11.2014 in a case registered for the offences punishable under Sections 147,148,341,323,324,307 and 504 of the Indian Penal Code.
The accusation of making assault to the informant and his son is against Shiv Shankar Pandey, Birendra Kumar and Rahul Kumar whereas Deepak is alleged to have taken out Rs.13000 from the pocket of the informant.
It is submitted by the learned counsel for the petitioner that the petitioner is not named in the FIR, his name subsequently sprang up. It is further submitted that there was serious land dispute between the parties and the title suit has been decreed in favour of the petitioner's side. Though the petitioner is accused in two other cased but statement has been made in paragraph 3 of the
Patna High Court Cr.Misc. No.776 of 2015 (2) dt.09-01-2015 2/2 petition that the petitioner is on bail in those two cases. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM, Ist Class, Madhubani in connection with Rahika P.S. Case No. 103 of 2014.
