JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 05.09.2014 in a case registered for the offences punishable under Sections 279, 337, 338, 304, 120B/34 of the Indian Penal Code.

Admittedly, petitioner was driver of the bus which met an accident at railway crossing and in the said crossing, two children died whereas several others sustained injuries. The investigation of this case has already been completed and admittedly, the said railway crossing was an unmanned railway crossing.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with
