The present application has been filed by the petitioner renewing his prayer for bail in connection with Kasim Bazar P.S. Case No.144 of 2013 registered under sections 25(1-B)(a), 26(1)(2) of the Arms Act and section 17/20 of the Unlawful Activities (Prevention) Act, 1967.

The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 8.7.2015 passed in Cr. Misc. No.18134 of 2015 with an observation that if the trial is not concluded within six months from the date of framing of charge, he would be at liberty to renew his prayer for bail. It has been contended by the learned counsel for the petitioner that the petitioner is in custody since 15.9.2013 and

No.5139 of 2016 (2) dt.18-02-2016 2/2 charges were framed by the court below on 20th July, 2015, but till date only two out of eight charge-sheeted witnesses could be examined during trial. It has further been contended that some other co-accused persons having identical allegations have already been granted bail by different benches of this Court. Considering the aforesaid, the petitioner, namely, Md. Azad is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Munger, in connection with Sessions Trial No.467 of 2014 arising out of Kasim Bazar P.S. Case No.144 of 2013.
