The petitioner is apprehending her arrest in a case registered under Sections 147, 148, 149, 341, 323, 325, 307, 354B, 504 and 506 of the Indian Penal Code.

The prosecution allegation, in short, is that the accused person entered into the house of the informant and assaulted her and also misbehaved her.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. A single iron blow is said to have been given by the petitioner on the left hand of the victim. There is no

Patna High Court CR. MISC. No.33271 of 2020(3) dt.09-04-2021 2/2 repetition of iron blow made by the petitioner. The injury is on the non-vital part of the body. The petitioner had no intention to commit offence under section 307 IPC. At best, it is a case for an offence under section 325 IPC.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned learned A.C.J.M. -I, Nawada in connection with Akbarpur P.S. Case No. 467/2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
