The petitioner, Butta Choudhary @ Prince @ Prince Kumar @ Raju Choudhary, seeks regular bail in Delha P.S. Case No.70 of 2014, registered under Section 394 of the Indian Penal Code.

The informant, a Goods Train Guard, lodged the case against unknown for robbing his belongings. It is submitted that the petitioner is not named in the first information report. Nothing has been recovered from the possession of the petitioner. Petitioner was arrested on 27.08.2014, but he was not put on T.I.P., although the informant claimed to identify the miscreant. The police took the confessional statement of the petitioner.

Perused the record.

Having considered the fact that except the confessional statement of the petitioner, the police did not collect any tangible evidence to show that the petitioner committed the robbery, his prayer for bail is allowed.

The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Gaya in connection with Delha P.S. Case No.70 of 2014.
