Petitioner seeks bail in a case registered under Sections-121(K)/ 122/ 123/ 120(B)/414 of the Indian Penal Code and Sections-3/4 of Explosive Substances Act as also under Section-16(Kha)/18/19/20 of UAPA Act.
Earlier prayer for bail of the petitioner was rejected by this court but submission on behalf of petitioner is that only one detonator is said to have been recovered from conscious possession of the petitioner and having more or less similar allegation, several co-accused have already been granted privilege of bail by different benches, including this bench of this court. The petitioner does not have any criminal antecedent and is
Patna High Court Cr.Misc. No.5124 of 2016 (3) dt.11-05-2016 2/2 languishing in jail custody since long.
Considering the above-said facts and circumstances of the case as well as submission of the parties and, also taking note of this fact that the explosive substance is said to have been recovered from the house of co-accused Babulal Paswan, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Deoriya P.S. Case No. 110 of 2014 to the satisfaction of learned Sessions Judge-cum-Special Judge, Muzaffarpur.
