Petitioners are apprehending their arrest in connection with Muzaffarpur Town P.S.Case No.787/2018 , registered for offences punishable under Sections 420, 409, 34 of the Indian Penal Code.

Prosecution allegation as per the written application filed by the information is that there was an agreement between the petitioners with respect to supply of E-rickshaw and the petitioners have taken Rs.6 lac and odd for supply of Erickshaw . Further there is also allegation of not submitting the

Patna High Court CR. MISC. No.32170 of 2019(2) dt.26-07-2019 2/2 GST return.

Submission of the learned counsel for the petitioners is that the FIR itself shows that the matter relates to the violation of the agreement and also of accounting as such no criminal case is made out against the petitioners. They are ready to abide by any condition imposed upon them.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Muzaffarpur in connection with Muzaffarpur Town P.S.Case No.787 of 2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
