JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 395 and 397 of the Indian Penal Code.
The accusation is of committing dacoity in the house of the informant. Name of the petitioner sprang up during investigation.
It is submitted by learned counsel for the petitioner that only on suspicion the petitioner has been roped in this case. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent and the co accused has already been acquitted.
Considering the fact that the case was instituted in
Patna High Court Cr.Misc. No.145 of 2015 (4) dt.29-01-2015 2/2 2010 and the impugned order reflects that the investigation with regard to the petitioner has been kept pending due to his non appearance, this court is not inclined to interfere in the matter. However, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Minapur P.S. Case No. 197 of 2010 pending in the court of learned C.J.M., Muzaffarpur.
This application is disposed of with the aforesaid observation/direction.
