2. The petitioner apprehends his arrest in a case registered for offence under Sections 30(a), 41 & 56 of the Bihar Prohibition and Excise Act.

3. The case of the prosecution, in brief, is that on 21.02.2024, the police caught a Tempo on suspicion bearing Registration No. BR01PP-5841 but the driver of the said Tempo managed to escape and on search, altogether 80.7 liters of illicit foreign liquor was recovered from the said Tempo and the petitioner is the registered owner of the said Tempo.

4. Learned counsel for the petitioner submits that without the knowledge or consent, the Tempo in question was being driven by the driver of the Tempo for transporting the aforesaid liquor. Petitioner has got no concern with the seized liquor.

5. Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail and submits that huge quantity of illicit liquor has been recovered from a Tempo, of which, this petitioner is registered owner.

6. Considering the same, the prayer for anticipatory bail of petitioner is rejected.
