JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-02-2022 Heard Mr. Ishtiyaque Ahmad, learned counsel for the petitioner and Mr. Dinesh Singh, learned Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Tarapur PS Case No. 185/2019 registered for the offence punishable under Sections 419, 420, 467, 468, 471/34 of the IPC. As per First Information Report, the allegation is that by impersonating and forging the thumb impression/signature of the informant, the land belonging to the informant situated at Mauja Parbhara having Khata No. 83, Khesra No. 1243, Area 40 decimal has been sold in favour of one Tankun Singh by the petitioner and other accused persons.

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he being the identifier in sale-deed was not aware about the identity of the vendor. He further submits that the petitioner is an

Patna High Court CR. MISC. No.43700 of 2021(2) dt.04-02-2022 2/2 illiterate villager and is engaged in the business of selling vegetables and he was told to put his thumb impression on the sale-deed as an identifier and the petitioner is not the beneficiary of the sale-deed.

Learned counsel next submits that petitioner being 70 years of age is in custody since 02.03.2021 having no criminal antecedent and the charge-sheet has been submitted. Regards being had to the submissions made by the parties and taking into consideration the material on record, the nature of allegation and the fact that petitioner is the identifier, being 70 years of age is in custody since 02.03.2021 having no criminal antecedent, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, PRADEEP SINGH @ PRADEEP KUMAR SINGH be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- Munger, in connection with Tarapur PS Case No. 185/2019.
