2. This Court had taken note of the show cause of opposite party nos. 1 to 3 on 15.2.2024 itself i.e. the order of the Hon'ble Apex Court by which the Hon'ble Supreme Court allowed the appeal preferred by the State.

3. The copy of the show cause was handed over to the learned counsel for the petitioner in the year 2021 itself and there is no rebuttal to the said averment.

4. Learned counsel for the petitioner submits that he may be granted liberty in the matter as though Hon'ble Supreme Court has allowed the appeal of the State of Bihar in similar situate matter to the best of his knowledge, in his case, the matter did not travel to the Supreme Court.

5. Without expressing any opinion, the MJC No. 518 of 2018 stands disposed of.
