The petitioner is the wife of the opposite party, namely, Sunil Kumar @ Sunil Kumar Sinha who has filed this application for transfer of Matrimonial Case No. 87 of 2015 from the Principal Judge, Family Court, Jehanabad to the learned Principal Judge, Family Court, Patna. The petitioner is a young lady dependent upon her old and ailing parents. It is causing much inconvenience to her to travel to Jehanabad from Patna to contest the matrimonial case. Considering the facts of the case, the Matrimonial Case No. 87 of 2015 is directed to be transferred from the Principal Judge, Family Court, Jehanabad to Principal Judge, Family Court, Patna.
After transfer of the case in the Court of Principal
Patna High Court MJC No.221 of 2018(8) dt.05-09-2022 2/2 Judge, Family Court, Patna, the Principal Judge,Patna, will issue notice to both the parties and, thereafter, the proceeding will continue in the Court of Principal Judge, Family Court, Patna. It is submitted by learned counsel for the petitioner that Maintenance Case No. 27 (M) of 2018 is pending before the Additional Principal Judge, Patna.
Learned Additional Principal Judge, Patna, is directed to dispose of the Maintenance Case No. 27 (M) of 2018 within a period of three months from today.
With the aforesaid observation and direction, this application is allowed.
