JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-07-2023 The present petition has been filed for restoring a petition bearing Cr.Misc. No.68267 of 2022, which has stood dismissed on account of non-compliance of the peremptory order dated 06.02.2023.

The learned counsel for the petitioner has submitted that on account of certain miscommunication, the defects pointed out by the registry could not be removed in time, hence the aforesaid petition has stood dismissed, however, it is submitted that the defects pointed out by the registry would definitely be removed, within a period of two weeks from today. Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the averments made in

Patna High Court CR. MISC. No.42359 of 2023(2) dt.05-07-2023 2/2 the present petition, I deem it fit and proper to direct for restoration of the aforesaid petition bearing Cr.Misc. No.68267 of 2022, to its original file, subject to the petitioner removing the defects, pointed out by the registry, within a period of two weeks from today.

The petition stands disposed off on the aforesaid terms.
