JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The name of petitioner came in confessional statement of co-accused, Golu Kumar who was caught near the tempo stand just after the alleged occurrence and informant claimed to have identified him at the time of his arrest. Contention on behalf of the petitioner is that except the confessional statement of co-accused, Golu Kumar as well as confessional statement of petitioner, there appears to be nothing against him and moreover, petitioner is in jail custody since 05.10.2015 but up till now, he has not been put on Test Identification Parade.

No.5408 of 2016 (2) dt.15-02-2016 2/2 Considering the aforesaid facts and circumstances as well as this aspect of the matter that petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Patna in connection with Budha Colony P.S. Case No. 253 of 2015.
