JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.
From the house of Ravindra Prasad, 219.84 quintals of wheat were recovered after breaking open the lock as female members of the family of Ravindra Prasad did not give key of the lock where the wheat was stored. The land owner Ravindra Prasad was not present. The mother of Ravindra Prasad suggested that the area has been taken on rent by the petitioner. It is submitted by learned counsel for the petitioner that there is nothing on record to suggest that the petitioner took the area on rent and admittedly recovery was made from the house of
Patna High Court Cr.Misc. No.4519 of 2016 (2) dt.02-02-2016 2/2 Ravindra Prasad.
The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Ghorasahan P.S. Case No. 202 of 2015 from the court of learned SDJM, Sikarhana at Dhaka, East Champaran.
It is expected from the learned court below to dispose of the regular bail application of the petitioner preferably on the same day.
Accordingly, the application is disposed of.
