JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but it would appear from perusal of the case diary that he was arrested in connection with Sindri P.S. Case No. 256 of 2012 and made his confessional statement disclosing his involvement in the present case also and except the aforesaid confessional statement, there appears to be nothing against him.

No doubt, in para 3 of the petition, the petitioner has not mentioned about the above stated Sindri P.S. Case No. 256 of 2012 but considering the facts and circumstances of the case as well as submissions of the parties and also keeping in mind that up till now petitioner has not been put on Test Identification Parade,

Patna High Court Cr.Misc. No.7937 of 2015 (3) dt.19-05-2015 let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge, Darbhanga in connection with Simari P.S. Case No. 254 of 2012 corresponding to Sessions Trial No. 290 of 2013. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
