The appeal is admitted.

In this case, the appellants are seeking anticipatory bail in connection with Barh P.S. Case No. 29 of 2020 registered for offence punishable under sections 341, 323, 324, 325, 504, 506/34 of the Indian Penal Code and sections 3 (i) (r) (s)/3 (2) (va) of the SC/ST (POA) Act.

Allegation has been made that the accused persons armed with revolver and iron rod, came and directed the informant to cut their grass and when the informant refused, the accused persons assaulted mercilessly, on that account, blood oozing started from his body.

Patna High Court CR. APP (SJ) No.2099 of 2020(2) dt.09-02-2021 2/2 Looking to the entirety of the matter, this Court is not inclined to grant bail to the appellants and accordingly their prayer for grant of bail is rejected. However, if the appellants surrender before the court below, the court below without being prejudiced by this order will decide the case of the petitioners on merit, preferably on the same day.
