The petitioner Gopal Sahni seeks bail in Minapur P.S. Case No. 281 of 2014, registered for the offences punishable under Sections 465, 471, 379 and 411 of the Indian Penal Code, Section 25(1-B)A,26,35 of the Arms Act and Section 17 of the C.L.A. Act.

Madan Kumar Singh the SHO of Minapur police station alleged that he got information that many naxalites were going on motorcycles and on such he intercepted and apprehended the accused persons.

Learned counsel for the petitioner submits that from the possession of the petitioner only a live cartridge was recovered besides a mobile of Nokia. The petitioner has got no criminal antecedent.

Patna High Court Cr.Misc. No.51969 of 2014 (2) dt.05-01-2015 Learned APP did not dispute the facts.

Having considered the facts that only a live cartridge and a mobile were recovered from the possession of the petitioner and for that he has remained in jail for about six months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P.S. Case No. 281 of 2014.
