====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 15-12-2020 Heard Mrs. Rina Sinha, the learned counsel for the petitioner and the learned Additional P.P. through video conferencing.

The petitioner seeks bail in Mahnar P.S. Case No.345 of 2019, registered under Sections 307 and 34 of the Indian Penal Code and under Sections 25(1-b) A/26/27/35 of the Arms Act.

The informant named six persons in the FIR including the petitioner, Saurav Kumar @ Lalbabu and alleged that they all knocked the door of his uncle. Ultimately his uncle opened the door. They took some articles from there and while the accused persons were going, they abused the informant. Harendra Rai, the brother of the informant, also came there. It is alleged that all the accused persons made firing on the informant but the informant saved himself. Abhishek Kumar fired which hit on the head of Harendra Rai, the brother of the informant, and Harendra Rai fell down on the ground.

Patna High Court CR. MISC. No.33348 of 2020(2) dt.15-12-2020 2/2 submits that the anticipatory bail petition of Pintu Kumar was allowed by this Court vide order passed in Cr. Misc. No.16950 of 2020, but the petitioner was arrested and that is why he withdrew his anticipatory bail petition vide order passed in Cr. Misc. No.16141 of 2020. It is further submitted that Harendra Rai got one abrasion and there is no firearm injury on the person of Harendra Rai. No other persons including the informant was injured in the alleged firing made by the accused persons. The petitioner is in custody since 09.08.2020.

Taking into consideration, as submitted by the learned counsel for the petitioner, that nobody was injured in the firing and the petitioner is in jail since 09.08.2020, the petitioner, namely, Saurav Kumar @ Lalbabu is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur in connection with Mahnar P.S. Case No.345 of 2019.
