JUSTICE SHIVAJI PANDEY ORAL JUDGMENT Date : 21-03-2018 Today, an affidavit has been filed by the State, annexing the Resolution dated 05.03.2018, wherein it has been mentioned that the petitioner would be paid the salary for the period from 01.01.1989 to 25.01.2000.

Learned counsel for the State submits that in view of such stipulation in the Resolution the order of this Court has been carried out.

Learned counsel for the petitioner submits that it is only the paper Notification, in actuality, the payment has not been credited to the account of the petitioner and further stated that he is entitled to Graduate Trained scale.

Patna High Court MJC No.3601 of 2000 dt.21-03-2018 2/2 So far the claim of entitlement of Graduate Traind Scale is concerned, the petitioner is at liberty to raise this issue before the appropriate forum as in the present proceeding this issue cannot be gone into.

So far the payment part is concerned, it is expected that the amount will be paid or credited to the account of the petitioner within a period of six weeks from today. If the respondents would fail to make payment within the stipulated time, the petitioner will be at liberty to file an affidavit for revival of this case.

With the aforesaid observations and directions, this application is disposed of.
