JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-02-2016 Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the State as well as learned counsel appearing on behalf of the complainant. The petitioner is in custody since 18.12.2015 in a complaint case in which prima facie case for the offence under section 467, 471 and 120B of the Indian Penal Code was found. The petitioner happens to be deed writer and accusation against him is that he in connivance with other accused got executed a sale deed in respect of lands of the complainant but submission on behalf of the petitioner is that the complainant wants to grab the share of one Late Nagina Devi, who happened to be daughter of
Patna High Court Cr.Misc. No.4739 of 2016 (2) dt.11-02-2016 2/2 Late Ram Padarth Singh and, as a matter of fact, the legal heirs of Nagina Devi had executed the sale deed in respect of lands in question.
Considering the facts aforesaid and submission of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/ - (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Patna in connection with Complaint case No. 61C of 2013.
