The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Haspura P.S. Case no. 37 of 2022 instituted for the offence under Sections 341, 323, 354, 354(A), 379 of the Indian Penal Code.
As per allegation in the FIR, when the informant and her sister-in-law were alone in their house then the the petitioner came her house and started molesting to the informant. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has got no criminal antecedent. It is further submitted vide 7 of the petition that on request of petitioner, the shopkeeper had given cement and Red worth of 4 lakh on lend
Patna High Court CR. MISC. No.34058 of 2022(2) dt.24-11-2022 2/2 to the informant's father and when the shopkeeper demanded money, the father of informant has not paid some dues and the informant's family had been residing in the house of petitioner as tenant more than 10 years due to which he has falsely been made accused in this case. The allegation against the petitioner is concocted.
Learned APP appearing for the state has opposed the prayer of anticipatory bail.
Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Haspura P.S. Case no. 37 of 2022, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daudnagar, Aurangabad subject to the conditions as laid down under section 438(2) of the Cr.P.C.
