The petitioner seeks bail in Bodh Gaya P.S. Case No. 09 of 2021 corresponding to NDPS Case No. 02 of 2021 (IA No. 05 of 2021), registered for the offence punishable under Section 420 and other allied sections of the Indian Penal Code and sections 30(a), 37(i), 37(ii) and 47 of the Bihar Prohibition & Excise Act, 2016 and section 20/22 of the NDPS Act. As per the prosecution case, one smart phone has been recovered from possession of this petitioner. It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. No incriminating article or narcotics have been recovered from conscious possession of this petitioner.
