The petitioner has renewed his prayer for bail in a case registered under sections 302, 201 and 34 of the Indian Penal Code.

It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order 4.1.2021 passed in Cr. Misc. No. 29948 of 2020. It is further submitted that the allegation of assault with a tangi is on the Manoj Singh and with Daab on Devendra Singh. The said Devendra Singh has been enlarged on bail vide order dated 10.2.2021 passed in Cr. Misc. No. 36395 of 2020. There is no chance of the trial concluding in the near future. The petitioner has remained in custody since 10.7.2018. He undertakes to

Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for over 3 years and grant of bail to co-accused Devendra Singh, the petitioner is directed to be enlarged on bail in connection with Sessions Trial no. 612 of 2018 (arising out of Barauli P.S. Case no. 128 of 2018) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge IV, Gopalganj.

The petitioner will cooperate in the trial in the learned trial Court. In case the learned trial Court is of the opinion that the trial is being delayed due to non-cooperation on part of the petitioner, it may take steps for cancellation of bail bond of the petitioner.
