The petitioner is apprehending his arrest in connection with Shambhuganj P.S.Case No.33 of 2019 registered for offences punishable under Sections 147, 341, 323, 337, 324, 338, 379, 452, 354, 504 and 506/34 of the Indian Penal Code. Prosecution case is that the petitioners have assaulted the informant and there is specific allegation against the petitioner no.1 of assault by Dabiya.
Submission of the learned counsel for the petitioner is
Patna High Court CR. MISC. No.33355 of 2019(4) dt.05-09-2019 2/2 that no specific allegation has been attributed against any of the petitioner and except the petitioner no.1 against him there is allegation of assault by Dabiya and there is case and counter case between the parties.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, so far petitioner no.1, named above is concerned, I am not inclined to grant privilege of anticipatory bail to the petitioner no.1.
So far petitioner nos. 3 to 6 and 8 above named are concerned, let the petitioner nos.3 to 6 and 8 , above named, are concerned in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Banka in connection with Shambhuganj P.S.Case No.33 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
