The petitioner is languishing in custody since 28.11.2013 in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

A truck loaded with 'Oal' was robbed leading to the registration of the FIR against unknown on the written report of Laxman Singh, the driver of the truck. The name of the petitioner sprang up on the confession of Santosh Kumar. It is submitted by learned counsel for the petitioner that the petitioner's name sprang up on the confession of Santosh Kumar, who has been granted bail vide Cr. Misc. No. 30373 of 2014. Patna High Court Cr.Misc. No.9883 of 2015 (04) dt.06-07-2015 2/2 his possession certain receipt paper containing some mobile numbers were recovered whereas during investigation it transpires that the 'Oal' robbed from the truck was sought to be sold by coaccused Manoj and Sonu. Learned APP after going through the case dairy has not controverted this contention of the petitioner that petitioner has not been put on TIP.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate (West), Muzaffarpur in connection with Kazra P.S. Case No. 140 of 2013.

Since the petitioner is accused in two other cases, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions or substantially gets involved in some serious offence. (Dinesh Kumar Singh, J) DKS/- U T
