JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date : 24-01-2019 Heard the petitioner in person; Mr. Shivendra Kishore, learned senior counsel along with Mr. Arabind Nath Pandey, learned counsel for the Magadh University (hereinafter referred to as the 'University') and learned AC to AAG-15 for the State.

2. Show cause has been filed on behalf of opposite party no. 7 disclosing that the contention of the petitioner has been found to be correct and accordingly, all retiral benefits in terms of actual pay drawn by the petitioner on the date of his superannuation i.e., Rs. 27,790/- have been sanctioned and paid.

3. Learned counsel for the University further submitted that all benefits in terms of such revised pay has also been paid to him which includes revision of pension, leave encashment, gratuity and arrears of pension.

4. The same is not disputed by the petitioner.

5. In view thereof, the application stands disposed off.

6. Before parting, the Court would record its appreciation for the effort of learned counsel for the University assisting the Court in this case for the reason that despite the authorities having to admit that the petitioner was correct and the

Patna High Court MJC No.2689 of 2018 dt.24-01-2019 3/3 office of the University was not being fair with him, still they have gone ahead and passed an order in his favour. This has mitigated the circumstances for the Court not to take notice and proceed against the University officers.

7. However, the Vice Chancellor and Registrar of the University are directed to send a strong and clear-cut message to all concerned, including the Class-III and Class-IV staff that if in future it is found that any person has been wrongly harassed, responsibility shall be fixed followed by quick and strict action.
