JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-01-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner seeks bail in Bhagwanganj P.S. Case No. 114 of 2019, registered for the offence punishable under Sections 302/34 of the Indian Penal Code and section 27 of the Arms Act.

Earlier the bail application of petitioner was rejected vide order dated 19.01.2021. Vide order dated 18.08.2021, report was called for regarding the stage of trial and same has been received (kept at flag 'R'), which reveals that charge has already been framed and case is fixed for evidence and trial is likely to be concluded within six months on restoration of normalcy of the impact of COVID-19.

Patna High Court CR. MISC. No.44410 of 2021(3) dt.22-01-2022 2/2 Regard being had to the nature accusation and the stage of trial, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. However, as the petitioner is in custody since 30.11.2019 trial court is directed to conclude the trial preferably within a period of one year.
