The petitioner seeks regular bail in a case registered for offence punishable under Sections 363/366A of the Indian Penal Code.

Learned senior counsel appearing on behalf of the petitioner referring to the First Information Report, submitted that the allegation against the petitioner has based merely on suspicion. He has further submitted that the victim girl made statement under Section 164 Cr. P.C., which has been brought on record (Annexure-2) to this writ application. He submits that she did not

He further submits that the petitioner is in custody since 01.09.2014, though there is no cogent material against the petitioner who implicates the petitioner in this case.

Considering the facts and circumstances, the above named petitioner, Ashish Kumar@ Lallu is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Ara Nawada P.S.Case No. 384 of 2014.
