The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code, Section 27 of the Arms Act, Sections 3, 4, 5 of the Explosive Substances Act, Section 17 of the C.L.A. Act, Sections 3/4 of the P.D.P.P. Act and different sections of the Unlawful Activities (Prevention) Act. Learned counsel for the petitioner submits that the informant is the wife of Sushil Pandey, who along with other persons is alleged to have been killed in a road mine blast. The informant named seven persons, namely, Sunil Singh, Baban Yadav, Mangal Ram, Naresh Yadav, Vinayak Singh, Nagendra Singh and Vijay Singh; out of whom, Naresh Yadav, Baban Yadav and Nagendra Singh have been enlarged on bail vide order passed in Cr. Misc. No. 38428/2014, Cr. Misc. No. 27689/2014

Patna High Court Cr.Misc. No.11602 of 2015 (2) dt.03-04-2015 2/2 and Cr. Misc. No. 37897/2014 respectively. The case of the petitioner stands on the same footing.

It appears that the informant calimed to identify seven persons including the petitioner and alleged that they planted landmine and the same exploded killing the husband of the informant and others. The case of the petitioner stands on the same footing as that of Naresh Yadav, Baban Yadav and Nagendra Singh.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. V, Aurangabad in Khudwan P.S. Case No. 47/2013.
