JUSTICE SHIVAJI PANDEY ORAL ORDER 11-03-2015 Heard learned counsel for the petitioner and the State. In this case, petitioner is seeking bail in Garkha P.S.Case No. 43 of 2012 registered u/s 302/34 IPC. For trifling issue, parties lost their temper and a free fight took place and in that assault, the victim died. Perused the case diary. It appears that the incident took place at the spur of moment. Petitioner is in custody since 16th July 2014.

In the facts and circumstances of the case, petitioner Chhotelal Mnjhi is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri A.K.Dwivedi, J.M., 1st Class, Chapra in connection with Garkha P.S.Case No. 43 of 2012

Patna High Court Cr.Misc. No.51450 of 2014 (3) dt.11-03-2015 2/2 subject to the condition that the petitioner would co-operate in the proceeding of the court below and if the petitioner will fail to cooperate and will remain absent for two consecutive dates without reasonable explanation, the court below will pass appropriate order, including cancellation of bail bonds.
