JUSTICE SUDHIR SINGH ORAL ORDER 20-12-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted for the offences under Sections 147, 149, 341, 323, 325, 452, 435, 379 and 506 of the I.P.C.
Allegation against the petitioners is that they assaulted the informant, set fire in her house and stolen away the house hold articles, ornaments and cash total worth Rs.70,000/- It has been submitted on behalf of the petitioners that the petitioners are in custody since 8.11.2016. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case due to previous enmity. General and omnibus
Patna High Court Cr.Misc. No.53487 of 2016 (2) dt.20-12-2016 2/2 allegation has been made. No specific overt act has been alleged against the petitioner. The other co-accused has been granted bail vide Cr.Misc.No.53946 of 2016.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bhabhua (Kaimur) in connection with Chainpur P.S. case No.225 of 2015.
