2. The petitioner seeks bail in a case registered for the offence punishable under Sections 392 of the I.P.C.

3. As per the prosecution case, four unknown persons on three motorcycles took away informant's tractor and two mobile phones of the drivers of the said tractor.

4. Learned counsel for the petitioner submits that the First Information Report was lodged against unknown miscreants with the allegation that the tractor of the informant and two mobile phones of the tractor drivers were looted. It is submitted that the name of the petitioner transpired during course of investigation in the confessional statement of the coaccused Vindhyachal Paswan from whose possession one

It is also pointed out from the bail rejection order itself that the looted tractor was also recovered from another co-accused. So far as the present petitioner is concerned, there is no recovery from his possession and he has not been put on Test Identification Parade till date. The petitioner is languishing in custody since 25.02.2026 and another similarly situated co-accused has already been granted bail by a co-ordinate Bench of this Court vide order dated 18.04.2019 passed in Cr. Misc. No. 14609 of 2019 (Annexure P/2).

5. Learned APP for the State opposed the bail petition on the ground that there is one antecedent of the petitioner.

6. In response, it is submitted that the case is not of similar nature and the petitioner is on bail in the said case.

7. Taking into consideration the facts and circumstances of the case and also considering the fact that no recovery has been made from the possession of this petitioner and he has not even been put on TIP coupled with the fact that now, the charge sheet has been submitted, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like

No.34823 of 2026(3) dt.11-06-2026 3/3 amount each to the satisfaction of the learned Chief Judicial Magistrate Rohtas at Sasaram/concerned Court below in connection with Sasaram P.S. Case No. 979 of 2018, subject to condition that:- (i) One of the bailors shall be a family member/close relative.

(ii) The petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.
