JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Runni Saidpur P.S. Case No. 95 of 2014 registered for the offences punishable under sections 25(1-b)(a), 26 and 35 of the Arms Act. According to the prosecution case, one country made loaded pistol is alleged to have been recovered from the possession of the petitioner. The petitioner is said to be in custody since 15th March, 2014.

It would appear from the record that the petitioner is accused in at least four other cases of serious nature. Regard being had to the facts and circumstances of the case, I am not inclined to grant bail to the petitioner for the present. Accordingly, the prayer for bail is rejected.

No.51571 of 2014 (2) dt.03-03-2015 2/2 Since the petitioner is in custody, learned Chief Judicial Magistrate, Sitamarhi is directed to hold the trial on day to day basis and conclude the same as early as possible preferably within six months from the date of receipt/production of a copy of the order, failing which the petitioner would be at liberty to renew his prayer for bail.
