JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-03-2015 Petitioner is languishing in custody since 14.12.2014 in a case registered for the offences punishable under Sections 307/34 of the I.P.C and Section 27 of the Arms Act.
Accusation against the petitioner is of causing fire arm injury on the buttock of the informant. It is submitted by learned counsel for the petitioner that in the background of land dispute the accusation has been levelled when there is no eye witness to the occurrence. A statement has been made in para 13 of the petition that injury has been found simple.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent and the investigation has concluded.
Considering the aforesaid facts, let the
Patna High Court Cr.Misc. No.10301 of 2015 (2) dt.19-03-2015 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Sultangunj P.S. Case No. 49 of 2014.
