Informant, Sahja Kumar Paswan who happens to be a driver of tractor bearing Registration No. BR1AG 1825 was intercepted by the criminals who, after confining the informant, took away his tractor along with trailer. Subsequently thereof, informant was thrown away and on account thereof, he informed the police who swung into action and during course thereof, traced out the tractor and trailer as well as apprehended two persons, Mukesh Kumar and Jitendra Kumar at that very moment who confessed their guilt, disclosed the identity of co-accused which includes the petitioner also. It is apparent from the case diary/supplementary case diary that petitioner was remanded in this case from Hathua PS Case No.31/2013 and then thereafter,

Patna High Court Cr.Misc. No.51547 of 2014 (4) dt.23-06-2015 without putting him on TIP, vide para-57 of the supplementary case diary, charge-sheet had already been submitted. Thus, petitioner, Tiwari @ Mirchai is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of ACJM, Danapur in connection with Bikram PS Case No. 23 of 2013.
