Petitioner is not named in the first information report and the specific stand of the petitioner is that at the time of alleged occurrence, he was in judicial custody in connection with another case and the aforesaid fact was observed by learned Sessions Judge in his impugned order but surprisingly enough that in spite of the aforesaid fact, learned Sessions Judge rejected prayer for bail of the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge IV, Siwan in Sessions trial no. 7/2015 arising out of Daraunda P.S. Case no. 97/1999.
