2. Learned counsel for the petitioner submits that vide order dated 24.06.2023 passed in the present proceeding, the petitioner was granted provisional bail taking into account the observation made in order dated 14.02.2023 passed in Cr. Misc. No. 53056 of 2022. Learned counsel for the petitioner further submits that in the order dated 14.02.2023 passed in Cr. Misc. No. 53056 of 2022, it was observed by a Coordinate Bench of this Court that the learned Court below will hold a conciliation meeting between both the parties and if the petitioner compensates the informant by paying the amount of his grain of the price mentioned above, then the learned Court below shall
Patna High Court CR. MISC. No.34664 of 2023(5) dt.23-02-2024 2/2 confirm the provisional bail and if the petitioner fails to return the said amount then the privilege granted to the petitioner shall stand cancelled automatically and learned Court below will take steps to get the petitioner in custody in the present matter.
3. This Court perused the order dated 24.06.2023 and finds that it was mentioned in the order that the Court also takes the same route taken by the Coordinate Bench in Cr. Misc. No. 53056 of 2022.
4. Under the circumstances, the Court below is directed to take same steps for confirming the provisional bail of the petitioner in connection with Khagaria P.S. case No. 462 of 2022, in terms of order dated 14.02.2023 passed in Cr. Misc. No. 53056 of 2022.
5. With the aforesaid observation/direction, the present application stands disposed of.
