JUSTICE AMARESH KUMAR LAL ORAL ORDER 23-06-2015 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

It is submitted that the name of the petitioner has appeared in the confessional statement of the co-accused Lalan Yadav, who disclosed the name of Vikash Kumar, Anuj Choudhary, Rakesh Mahto and Dipu Yadav @ Lambua (petitioner). During T.I. Parade, the informant identified Shyam Gope as an assailant, who has shot fire causing the death of his brother Amarjeet Kumar. The co-accused Lalan Yadav has been granted bail vide Cr. Misc. No.8187/2015 and other similarly situated co-accused Vikash Kumar @ Vikash Gope has also been

Patna High Court Cr.Misc. No.7699 of 2015 (5) dt.23-06-2015 2/2 granted bail vide Cr. Misc. No.42383/2014 and the case of the petitioner is on similar footing.

The learned counsel for the State submits that the petitioner has a long list of criminal antecedents. Considering the facts and circumstances of the case, let the above-named petitioner be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1, Hilsa, Nalanda in Sessions Trial No.786/13 arising out of Chandi P.S. Case No.22/2013 with the following conditions : 1.

One of the bailors will be the close relative of the petitioner.

The petitioner will not indulge in similar or in any other offence.

3.

The petitioner will be well represented in the court.

4.

In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
