Petitioner is in jail custody since 22.10.2014 in a case registered under sections 341, 323, 452, 354, 354A, 376, 511/34 of the IPC and 27 of the Arms Act.

The contention on behalf of the petitioner is that this case has been brought due to rivalry on account of packs election and moreover, no specific overt-act has been attributed against the petitioner.

It would appear that from perusal of the first information report that the petitioner and two other accused started dragging the informant as well as younger daughter with bad intention and also made firing but except the aforesaid allegation, there appears to be nothing against the petitioner. Petitioner does not have any criminal antecedent.

Patna High Court Cr.Misc. No.269 of 2015 (2) dt.08-01-2015 Considering the aforesaid facts and circumstances as well as submissions of the parties and period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Barhara P.S. Case no.258/2014.
