Petitioner along with Umesh Mahto and Ganeshi Mahto is said to have pulled the deceased, Laxman Mahto, whereupon so many persons numbering 33, dragged, taken to near a tree, tied and then, assaulted him with fists, slaps, danda and belt till his death. The act suggests the situation of primitive stage of civilization having been effected in barbaric manner. However, to maintain parity of the order as co-accused, Umesh Mahto, having similar allegation had already been granted bail vide order dated 09.10.2012 passed under Criminal Miscellaneous No.26316 of 2012, petitioner found entitled for bail.

Accordingly, petitioner, Sunil Mahto is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten
