====================================================== CORAM: HONOURABLE MR. JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 10-02-2022 Heard the parties through video conferencing. The petitioner apprehends his arrest in connection with Agamkuan P.S. Case No. 476 of 2020 registered for the offence under Sections 30 (a), 41 (i) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is neither the owner nor the driver of the truck. The truck was found in abandoned condition. Merely, the petitioner's workshop is nearby the place where the truck was recovered by the Police.

In view thereof, I am satisfied that prima facie no case under Section 30 (a) is said to be brought against the petitioner,
