JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 30.09.2015 in a case registered for the offences punishable under Sections 20 and 22 of the NDPS Act.
The petitioner and one Guddu Yadav was intercepted while travelling on the motorcycle. The petitioner was the pillion rider and he was carrying bag containing 121/2 kgs of Ganja. It is submitted by learned counsel for the petitioner that the petitioner has no criminal antecedent, statement to that effect has been made in para 3 of the petition. Moreover, investigation has already concluded. Recovery of contraband is between small and commercial quantity.
Considering the quantity of recovery of contraband, this
Patna High Court Cr.Misc. No.8583 of 2016 (3) dt.09-03-2016 2/2 Court is not inclined to grant bail to the petitioner at present. Accordingly, the prayer for bail is rejected in connection with Barun P.S. Case No. 141 of 2015 pending in the court of learned Sessions Judge cum Special Judge, Aurangabad.
