JUSTICE SANDEEP KUMAR ORAL ORDER 10-02-2022 At the very outset, learned counsel for the petitioners seeks permission to withdraw the present anticipatory bail application as against petitioner No. 1 (Binod Sah). Permitted to be withdrawn.
It is, thus, dismissed as withdrawn as against petitioner No. 1.
Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
Heard learned counsel for the petitioner and learned counsel for the informant as well as learned Additional Public Prosecutor for the State video conferencing.
Patna High Court CR. MISC. No.42806 of 2021(2) dt.10-02-2022 2/3 The petitioner apprehends her arrest in connection with Muraliganj P.S. Case No. 355 of 2020 registered for the offences punishable under Sections 147/148/149/341/323/307/ 302 of the Indian Penal Code.
So far petitioner No. 2 is concerned, she is a lady and there is general and omnibus allegation against her. Considering the facts that there is land dispute and both the parties are close relatives, the present anticipatory bail application of petitioner No. 2 is allowed.
Accordingly, let the petitioner No. 2 (Kanchan Devi) above named be released on bail, in the event of her arrest or surrender before the court below within a period of ten weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, VI, Madhepura, in connection with Muraliganj P.S. Case No. 355/20, subject to the conditions as laid down under Section 438
(2) of the Cr.P.C.
The petitioner No. 1 is directed to surrender within four weeks. If the petitioner No. 1 does not surrender within a period of four weeks, the Superintendent of Police, Madhepura, will take all coercive steps for arresting him.
