JUSTICE ARVIND SRIVASTAVA ORAL ORDER 02-02-2023 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant. The petitioner apprehends his arrest in connection with Kankarbagh P.S. Case No. 1163 of 2021 registered under Sections 509, 323, 498A and 406/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that the informant not only cruel towards her husband and in-laws but also towards her own daughters. The affidavit sworn by the daughters of the petitioner is contained in Annexure-2 and 2/1 to
Patna High Court CR. MISC. No.34814 of 2022(4) dt.02-02-2023 2/2 the bail petition. He also submits that the petitioner has filed a suit for dissolution of marriage with the informant in the Family Court, Ranchi registered as Original Matrimonial Suit No. 674 of 2021 (Annexure-3). Petitioner has got no criminal antecedent. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Judicial Magistrate-I, Patna in connection with Kankarbagh P.S. Case No. 1163 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
